Teen in stand: Dance teacher molested me

QUEENSBURY -- The teenager who has accused a local dance instructor of repeated sexual abuse told a Warren County jury Wednesday that the man molested him repeatedly over a nine-year period.
The teen testified that Timothy McGuire fondled him and had the boy reciprocate well over a dozen times between the ages of 6 and 14.
Now 19, the young man testified that McGuire told him after the first encounter not to tell anyone or he wouldn't be allowed to come over to McGuire's dance studio and home anymore.
"He said he loved me like a son and if I told I wouldn't be able to come over again," the teen testified.
The teen spent the day on the witness stand in the second day of McGuire's trial on course of sexual conduct against a child and sexual abuse charges. The teen was a longtime student at McGuire's dance studio, Tim McGuire Dance Centre.
The young man testified that McGuire sexually abused him one morning after the boy, then 6, slept over at McGuire's home. He said McGuire showed him a pornographic magazine, then had a sexual encounter that was the first of many.
He told Warren County Assistant District Attorney Kevin Donlon that, last April, he lashed out at McGuire, slashing the tires of his vehicle, after he saw that McGuire seemed to be having a close relationship with another young male student. He went to authorities the next day to accuse McGuire.
"I saw him getting close to another kid... I became concerned," the teen said. "I was angry at what he had done to me."
He said he was prosecuted for the car vandalism and will have to pay McGuire for the repairs.
Defense lawyer Tucker Stanclift focused his cross-examination on inconsistencies in the young man's statements to police and prosecutors and testimony before the grand jury as well as the teen's admitted marijuana use. He questioned whether the allegations were fabrications that came after marijuana use.
Stanclift also pointed to postings on a social networking website after McGuire's arrest in which the teen admitted writing a phrase that referred to the "lies I put in place" and pointed out that he told another friend on the website that he planned to write a book about the matter.
The day's testimony also saw frequent sparring between the lawyers, to the point that Warren County Judge John Hall had to yell at them and send the jury out to warn the lawyers about talking at the same time.
"I want the jury to decide this case on the facts, not the hysterics of the attorneys," Hall told them.
He also warned spectators in the court gallery about audible comments, telling them they could be jailed for interfering with the trial.
McGuire, 49, showed no emotion as he sat in court during the day's proceedings.
Testimony is to resume Thursday morning with a continued cross-examination of McGuire's accuser.

California brothers opt to go on trial facing charges they tortured child molester Avelino Rodriguez

Two vigilante brothers accused of taking the law into their own hands are leaving their fate in the hands of a California jury.
Miguel and Erik Cerda, over the tearful pleas of their mother, opted for a trial Tuesday rather than a plea deal on charges that they viciously battered a convicted child molester.
The man was attacked after duct-taping the mouth of an 8-year-girl so she couldn't scream as he sexually molested her last Thanksgiving. He was sentenced to 22 years in prison earlier this month.
Molester Avelino Rodriguez was whipped, punched and burned with a cigarette in retaliation for the incident, prosecutors said.
Miguel Cerda considers himself a stepfather to the abused girl, and has a longterm relationship with the child's mother. The couple has two children of their own.
Cerda and his brother, both of San Jose, Calif., turned down a deal that could have allowed them to serve just two years in prison.
If they are convicted, the judge is required by law to sentence the brothers to seven years to life in prison.
The duo is charged with several felony counts, including torture and mayhem, that carry the stiffer sentences. The pair wavered back and forth for most of a day before deciding to face trial.
" This relates to Bait because the man was like a stepfather to the girl which seems like the case Diego was in with Mac. The guy had a relationship with the girls mother and he had a kids of their own somewhat like Eddie."
